PomoPlan is a productivity tool, not medical treatment or a guarantee of focus or performance. Your statutory consumer rights are not limited by these terms.
1. Acceptance of these terms
These Terms of Use (“Terms”) are an agreement between you and the independent publisher of PomoPlan (“PomoPlan,” “we,” “us,” or “our”). They apply to the PomoPlan applications for iPhone and Apple Watch, widgets and complications, the website at pomoplan.io, and related support (together, the “Services”).
By downloading, accessing, or using the Services, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Services.
You must be legally able to enter this agreement. If you are under the age of legal majority where you live, a parent or guardian must review and agree to these Terms where required.
2. App Store license
PomoPlan is distributed through Apple’s App Store. Apps obtained through the App Store are licensed, not sold. Unless the App Store listing presents a separate custom end-user license agreement, your license to the app is governed by Apple’s Standard Licensed Application End User License Agreement and applicable App Store usage rules.
Subject to those rules and these Terms, you may use PomoPlan for personal or internal purposes on Apple-branded devices you own or control. You may not copy, distribute, rent, lease, sell, sublicense, reverse engineer, bypass technical restrictions, or create derivative works from PomoPlan except where applicable law or an open-source license expressly permits it.
Apple is not responsible for providing maintenance or support for PomoPlan beyond any obligation Apple has under applicable law or its own terms. Contact PomoPlan for product support.
3. Using PomoPlan
You are responsible for how you configure and use the Services, including timer durations, notification settings, Focus Guard selections, score penalties, and whether you rely on a completion alert.
You agree not to:
- use the Services in a way that violates applicable law or the rights of another person;
- interfere with, overload, probe, or attempt unauthorized access to the Services or related systems;
- use automated means to scrape the website or extract app assets except as allowed by law;
- misrepresent your relationship with PomoPlan or use PomoPlan branding in a misleading way; or
- use the Services where failure, delay, or an inaccurate timer could cause death, personal injury, or serious physical, financial, or environmental harm.
4. Your content and data
You retain your rights in the topic names, tasks, notes, session records, and other content you create in PomoPlan. You are responsible for that content and for keeping suitable backups when it matters to you.
You give PomoPlan only the limited permission needed to process that content on your devices and through the platform services you enable, such as private iCloud sync and WatchConnectivity. We do not claim ownership of your personal task or session content.
How data is handled is explained in the Privacy Policy.
5. Apple services and device features
Parts of PomoPlan rely on Apple-provided systems, including the App Store, iCloud and CloudKit, notifications, Focus modes, Family Controls and Screen Time, WatchConnectivity, WidgetKit, Live Activities, and device operating systems.
Those systems are outside PomoPlan’s control. Their availability, timing, routing, permissions, and behavior may vary by device, region, settings, connectivity, Apple Account state, battery conditions, operating-system version, and Apple policy. Apple’s terms and privacy policy also apply to your use of Apple services.
PomoPlan cannot guarantee that a notification will override a Focus mode, arrive with sound, appear on a particular device, or be delivered at the exact timer boundary. Do not rely on PomoPlan as an emergency, safety, medical, or mission-critical alarm.
6. Purchases, pricing, and refunds
If PomoPlan is offered as a paid download, subscription, or in-app purchase, the price and billing period will be shown before purchase. Apple processes App Store payments, taxes, renewals, cancellations, Family Sharing eligibility, and refund requests under your Apple Account and Apple’s terms.
We do not directly receive or store your full payment-card details. Refund eligibility is determined by Apple and applicable law. Nothing in these Terms removes rights you have under mandatory consumer law.
7. PomoPlan intellectual property
The Services—including software, design, illustrations, cat companion artwork, icons, text, branding, and other materials supplied by PomoPlan—are owned by PomoPlan or its licensors and are protected by intellectual-property laws. The limited app license does not transfer ownership to you.
If you send suggestions or feedback, you allow us to use them without restriction or compensation, provided we do not publicly identify you as the source without permission.
8. Updates, availability, and changes
We may improve, update, add, remove, or discontinue features. Some updates may be required for compatibility, security, synchronization, or continued operation. Older devices or operating-system versions may not support every feature.
We try to keep the Services reliable, but they may be interrupted or unavailable because of maintenance, bugs, connectivity, device conditions, Apple services, or events outside our reasonable control. We do not promise that every issue will be corrected or that the Services will always be available.
9. Productivity and wellbeing disclaimer
PomoPlan provides timers, planning prompts, scores, streaks, app shielding, reflections, and motivational content for general productivity and personal organization. It is not a medical device and does not provide medical, psychological, diagnostic, or therapeutic advice.
References to attention, distraction, rest, habits, or ADHD experiences are educational or personal context, not a claim that PomoPlan treats a condition. Seek qualified professional help for medical or mental-health concerns.
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We do not make warranties beyond those that cannot legally be excluded, including implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, or non-infringement.
10. Limitation of liability
To the maximum extent permitted by applicable law, PomoPlan will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss; lost profits, revenue, opportunity, goodwill, or data; or loss caused by missed alerts, timer differences, unavailable platform services, Focus Guard configuration, or your reliance on productivity scores.
Where liability cannot be excluded, it will be limited only to the extent the law allows. Some countries and regions do not allow certain exclusions or limitations, so parts of this section may not apply to you. These Terms do not exclude liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable.
11. Suspension and termination
You may stop using PomoPlan at any time. Your app license may end if you materially violate these Terms or Apple’s applicable license terms. Provisions that by their nature should continue—including ownership, disclaimers, liability limits, and dispute provisions—survive termination.
12. Applicable law and disputes
Before starting a formal dispute, please contact support@pomoplan.io and give us a reasonable opportunity to resolve it.
These Terms are governed by the laws that apply to the PomoPlan publisher, without applying conflict-of-law rules, except that mandatory consumer protections and any rights tied to your usual country of residence remain unaffected. Courts with jurisdiction under applicable law may hear disputes. Apple’s Standard EULA separately states the law and forum applicable to that license.
If any provision is unenforceable, it will be limited or removed only as much as necessary, and the remaining provisions continue. A delay in enforcing a provision is not a waiver. These Terms, the Privacy Policy, Apple’s applicable license, and any purchase terms shown at checkout form the relevant agreement for the Services.
13. Changes to these terms
We may update these Terms to reflect changes to PomoPlan, platform requirements, or law. The effective date at the top will be revised. If a change materially affects your rights, we will provide reasonable notice through the app, website, or App Store listing where appropriate.
